國民黨立委王育敏提出《刑法》修正版本，明定故意殺害12歲以下孩童者，原則上應處死刑，只有少數因貧困、久病等造成的殺子孫案，才可適用無期徒刑；藍委徐志榮也提修法，規定殺童者處以死刑或無期徒刑，並不得假釋。

立法院司法及法制委員會明天將審查《刑法》修正草案，規定故意殺童者處死刑。對此，民進黨立委徐國勇昨表示，此修法無意義，現行殺人者，若情形嚴重即可判處死刑、無期徒刑，反倒是「不得假釋」才有實質意義，或是犯罪可判100、200年，即使假釋也至少關50年，「等於是關到死」，這樣社會才不會有對立與爭議。
